User Agreement
This User Agreement (the "Agreement") is a legal agreement between the autonomous non-profit organization EEVA ("EEVA") and the individual entering EEVA (the "Author") regarding the demonstration of the personal audio visual works ("Videos") on the Internet web site eeva.pro ("the Site") and in the electronic periodical of EEVA (the "Catalogue"). The Author is the individual who has accepted this User Agreement and submitted one or more personal videos to the site.
1.The Author submits videos to the Administration for publication on the Site and in the Catalogue under the terms and conditions specified by the Agreement.
2.The Author must read the Agreement before registering at the Site.The Agreement comes into force immediately after the Author accepts the terms and conditions by checking the box "Accept the terms and conditions of the User Agreement". The Catalogue only contains videos uploaded via the user interface. To be eligible to upload Videos the Author must accept the Agreement in order to avoid any differences regarding copyright. The Author shall be solely responsible for any copyright violation.
3.Terms of Submitting Videos
3.1 EEVA can only publish Videos on the Site and in the Catalogue if they meet the technical requirements specified in this Agreement
3.2 EEVA is a non-profit social service, for this reason Authors are not remunerated for the submitted Videos
3.3 By accepting the Agreement and submitting Videos to EEVA, the Author hereby grants EEVA worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display the Videos and the photos submitted by the Author in connection with EEVA including without limitation for promoting and advertising.
3.4 EEVA expressly disclaims any and all liability of EEVA and its affiliates, subsidiaries, service providers, licensors, officers, directors or employees in connection with copyright infringing activities and infringement of intellectual property rights resulting from the public access to the Videos.
3.5 The Author retains all copyright or other proprietary rights to the Videos submitted personally by the Author unless otherwise expressly stated. The Author is warned that they are solely legally liable for unauthorized use and copying of another person′s copyrighted works. If it is established that the Author does not own or have the necessary licenses, rights, consents, and permissions to publish the Videos they have submitted, EEVA will immediately remove all misused content if properly notified by the lawful copyright holder.
3.6 The administration expressly specifies the name of the Authors of the Videos and adds it to the file properties.
3.7 By submitting Videos the Author hereby grants each member of EEVA, each visitor, or each prospective client a non-exclusive license to access the Author′s Videos through the service.
4.The Videos submitted to the Site cannot:
- infringe any laws, violate another person′s rights including minors;
- contain incitement to discrimination or violence against any people on account of their race, national origin, religion, age, gender, disability, or sexual orientation;
- contain episodes of violence or animal abuse;
- contain obscenity or pornography;
- propagate narcotics;
- infringe copyright or violate rights of any third party;
- contain any kind of commercial advertisement.
5.Limitation of Liability
5.1 EEVA reserves the right to decline any submitted Video or remove any Video without prior notice if the Video fails to comply with he technical or legal requirements; or if it violates this Agreement or the rules of the Site.
5.2 EEVA makes no warranty that the service will meet all Author’s requirements; that the service will be uninterrupted, timely, secure, or error-free. EEVA is not obliged to maintain back-up copies of any material submitted or posted on the Site. The Author expressly understands and agrees that EEVA and its affiliates, subsidiaries, service providers, licensors, officers, directors or employees shall not be liable under any circumstances for any indirect, general, incidental, special, consequential, exemplary or other damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses.
5.3 The Author expressly agrees that they shall be solely responsible for their own Videos and the consequences of submitting and publishing their Videos on the Service. EEVA cannot control, or be held responsible or liable, for any of the content that appears on the Site, for any law or copyright infringement or violation of rights of any third party resulting from the publishing of the Videos on the Site. In case EEVA receives any complaint from a third party regarding the Videos published on the site, the Author is obliged to settle all the differences at their own expense and at their own discretion.
6.Technical Requirements
6.1 The Video can only be published if it fully complies with the requirements specified in this clause. EEVA reserves the right not to publish the Video if it fails to comply with these requirements.
6.2 Unacceptable extremely poor quality video.
6.3 Video no must be less 30 sec. or more than 15 minutes long.
6.4 The video should be at least 720x405 pixels, 1280x720 pixels is the more preferable size.
6.5 Video can be in the format 16x9. Format 4x3 is no longer used in video production.
6.6 We have a permanent system of voting for the video - are entitled to vote, only members EEVA. Videos that have the lowest scores will be deleted.
6.7 Each video must contain the name of the Author or video studio in a caption or break bumper.
6.8 The Video can only be published on the site by submitting a code from a video hosting through the user interface.
7. The Author agrees that this Agreement constitutes the entire, complete and exclusive agreement between the Author and EEVA, and its terms and conditions govern the Author’s use of the Site for publishing Videos.
8. This User Agreement and any disputes arising out of or related to the Site shall be governed by, and construed and enforced in accordance with, the laws of the Russian Federation.
9. If the Author believes that their work has been copied and is accessible on the Site in a way that constitutes copyright infringement, they may notify Service Provider by filing a complaint, the email address for such purposes is specified in the contact details. The Video will be immediately removed upon request of the lawful copyright holder.
10. EEVA may revise the User Agreement, in whole or in part, without notice, and it is the Author’s responsibility to review this User Agreement for any changes.
11. In case of any amendments or newly adopted legal acts affecting in whole or in part the performance of the Site, EEVA reserves the right to make any amendments to bring the Site into compliance with the Law.
